The Supreme Court’s decision in Volcafe v CSAV appears to have overruled the traditional regime that governed the allocation of the burden of proof in cargo claims under the English incarnation of the Hague-Visby Rules, and to go against the broad principles accepted transnationally. The author argues for a narrow interpretation of the decision to avoid exacerbating potential conflicts in international shipping law

Learning how to cabotage: Reforming the Jones Act

Reform of the 100-year-old Jones Act is urgent. The protectionist stance of the Act restricts the US coastal shipping trade to US built, owned, flagged and crewed vessels, leading to high costs for shippers on the mainland and contiguous states and a decline in the shipping industry. A critique of the legislation against the backdrop of the realities of shipping in the 21st century is followed by an evaluation of the respective cabotage legislation of Brazil, the EU and Nigeria as a basis for potential reforms to the US coastal laws.
